What is the right to receive for the next of kin of a person who has died in an accident?

Several types of compensation can be claimed in the event of an accident resulting in death. Relatives can claim property compensation to cover expenses incurred in connection with the tragic accident, such as funeral and travel costs.

In addition to compensation for material damage, family members may also be entitled to claim a so-called damage award (non-pecuniary compensation). The amount depends on many things. These may include age, the degree of kinship, the depth of the relationship with the deceased, etc. Nevertheless, established case law provides a kind of benchmark for relatives, so that a maximum - relatively regulated - amount can be reached by obtaining appropriate evidence.

 

In addition to these, dependants of the deceased (such as children, elderly parents, spouses) can claim a so-called maintenance allowance, which can be used to replace the income lost by the person who died in a fatal accident.
