Compensation procedure
In general, the compensation procedure can be divided into several stages. The duration of the procedure depends mainly on the nature of the case, its complexity, the attitude of the tortfeasor (insurer) and the ideas of the injured party or his representative.
The stages of the compensation procedure:
- Is there a case?
The first step is to establish whether there is a case, i.e. to assess the circumstances of the accident, the mechanism of the accident, and to weigh up the available evidence and circumstances. We then provide free legal advice to accident victims who come to us. As part of the advice, we will tell you whether the victim has a legal right to make a claim against the tortfeasor and what risks you should expect.
- Commissioning
If a client wishes to instruct us as their lawyer, our law firm will make them a fair offer.
We offer success fee schemes for all accident injured Clients, so our Clients only pay a legal fee if we have done our job successfully! If our Client accepts our offer, we will start handling your case and preparing your claim immediately after signing the engagement agreement.
- Procedure
Depending on the nature of the accident and the nature of the case, we represent our client's interests in out-of-court or in court proceedings.
As regards the out-of-court procedure, it is worth knowing that the exact amount of compensation can be determined after the so-called final status has been established. This means waiting to see if there will be any further improvement in the injury resulting from the accident. In this way, it is possible to see what adverse consequences the injury will have for the Client in the future, possibly in terms of permanent disability or impairment of health.
If the out-of-court negotiations do not lead to a successful settlement with the tortfeasor, we will pursue our Clients' claims for damages in court, subject to the decision of our Clients.
- Enforcement, liquidation
Unfortunately, it is becoming increasingly common for tortfeasors to fail to pay the compensation awarded by the court, even on the basis of a final court decision. In such cases, we initiate enforcement or, where appropriate, liquidation proceedings against the tortfeasor.
As our law firm works on a contingency fee basis, it is in our mutual interest to represent our Clients' interests to the maximum.
